Legal Representation & Proceeding

The litigation of your dispute before the Court is an expensive process. This is why it is important to exercise every reasonable effort to resolve your dispute without litigation by either talking to or writing a formal demand letter to your opponent.

Depending on the amount of your claim, the Superior Court of Justice provides three available procedures. The claims over $50,000 are commenced using regular procedure in Superior Court of Justice. The procedure involves the exchange of pleadings (Statement of Claim, Statement of Defence, Counterclaim, Reply to the Statement of Defence, Third Party Claim, Cross-Claim). Before the matter goes to trial, the parties exchange all relevant documents and go through formal discovery process before official examiner. The process is complicated and can take more than a year.

The Superior Court of Justice provides the litigants with Simplified Procedure with less formal process to litigation for the claims under $50,000. This procedure does not involve examination for discovery and is less expensive and in the most cases takes less than a year to complete.

In certain situation, it is possible to expedite either of the procedures by making a motion for summary judgment, where the judge may grant a judgment without requiring the parties to go to the trial.

The claims under $10,000 are resolved in Small Claims Court. The procedure is simple and expedient and normally takes less than 6 months to complete.
